We offer commercial embroidery education, consulting, speaking services, laser-cut appliqué kits, digital production files, and professional instruction through this website and our course platform.

Acceptance of Terms
By accessing our website or purchasing any product or service, you confirm that:
  • You are at least 18 years of age and have the legal authority to enter into a binding agreement.
  • You agree to comply with these Terms and all applicable federal, state, and local laws.
  • You understand that different products and services are governed by different sections of these Terms, and you agree to all sections applicable to your purchase.
If you do not agree with any part of these Terms, do not complete a purchase or book a session.

Online Courses — The Library
4.1 Course Description
Online courses sold through AppliqueJoe.com are pre-recorded digital education products delivered through our course platform (Course Creator 360 / GoHighLevel). Each course includes video modules, downloadable reference materials, and supplemental resources as described on the course sales page at the time of purchase. Courses are delivered to your account immediately upon payment confirmation.
4.2 Lifetime Access
Your enrollment grants you lifetime access to the course as long as AppliqueJoe.com operates the course platform and the course remains available. We reserve the right to update, modify, or retire course content with reasonable notice. Retired content will not entitle you to a refund if equivalent or improved content has been made available.
4.3 Refund Policy — 7-Day Guarantee
We stand behind our course content. If you complete the first module and feel the course is not right for you, contact us within 7 calendar days of purchase and we will issue a full refund — no questions asked. After 7 days, all course sales are final. The 7-day window begins at the time of purchase, not the time of first login.
What Qualifies for a Refund
Refund requests must be received in writing (email to reply@appliquejoe.com) within 7 calendar days of purchase. No documentation, reason, or proof of completion is required within this window. After 7 days, no refunds will be issued under any circumstances, including dissatisfaction with results, equipment incompatibility, or change of mind.
4.4 Payment Plans
Select courses offer installment payment options (e.g., 4 payments of $79). By selecting an installment plan, you authorize us to charge your payment method on the schedule presented at checkout. Missed payments will result in suspension of course access until the payment is brought current. You remain obligated to complete all installment payments regardless of how much of the course you have consumed.
Grace Period — Payment Plans
If a scheduled installment payment fails, you have 7 calendar days to update your payment method and bring the account current. Your course access will be suspended during this period. After 7 days without resolution, access may be permanently revoked and any amounts already paid will be forfeited as partial consideration for the access already consumed.
4.5 Course Access License
Your enrollment grants you a personal, non-transferable, non-exclusive license to access and view the course content for your own education and internal business development. You may not:
  • Share your login credentials or access links with any other person.
  • Screen-record, download (beyond provided downloads), or reproduce course video content.
  • Use course content — including methods, frameworks, or proprietary terminology — to create competing educational products, courses, or instructional materials.
  • Publicly attribute our proprietary techniques or methods as your own original teaching.
4.6 No Outcome Guarantee
Course content reflects the instructor's professional experience and methods. We do not guarantee any specific production result, skill level, business outcome, or revenue following course completion. Your results depend entirely on your own effort, equipment, materials, software, and application of the instruction provided.

Appliqué Kit Packages
5.1 What's Included
Appliqué Kit Packages include: (a) pre-cut laser-cut fabric components sized and prepared per the design specifications, (b) a digital embroidery stitch file (.DST or equivalent), and (c) a digital laser cut file (.PLT, .AI, or equivalent). All three components are required for proper production. The stitch file and cut file are licensed for commercial production use as described in Section 5.3.
5.2 All Kit Sales Are Final
Because each kit is custom-cut and prepared specifically for your order, ALL SALES ARE FINAL once your kit has been shipped. We do not offer refunds, exchanges, or returns on physical kit packages for any reason, including:
  • Change of mind or order error on the customer's part.
  • Dissatisfaction with production results achieved using the included stitch file.
  • Machine incompatibility, operator error, or incorrect garment selection.
  • Carrier delays or damage in transit not reported within 7 days of delivery.
If your order arrives damaged or contains incorrect items due to our error, contact us within 7 days of confirmed delivery and we will work to resolve the issue at our sole discretion.
5.3 Commercial Production License — Included Files
What This License Allows
Your kit purchase includes a single-use commercial production license to the included stitch file and cut file. You may use these files for commercial embroidery and appliqué production within your own business operation, including high-volume production runs.
This license explicitly does not permit:
  • Resale, sublicensing, transfer, or distribution of the stitch file or cut file to any third party.
  • Use of the files in any course, tutorial, or educational content without prior written consent.
  • Representing the included files as your own original digitizing work.
  • Modification of the files for the purpose of creating derivative works for redistribution.
The stitch file and cut file remain the intellectual property of AppliqueJoe.com at all times. This license does not transfer ownership of any file.
5.4 Color & Material Variance
Fabric colors shown in product images are representative. Due to dye lot variations between production runs, monitor display differences, and the natural characteristics of woven and non-woven materials, actual colors may vary. Color variance is not grounds for a refund or exchange.
5.5 Production Responsibility
AppliqueJoe.com provides the kit components and production files as tools for your use. We are not responsible for results achieved based on your machine settings, hooping methods, garment selection, operator technique, or use of materials beyond those we supply.

Native File License
6.1 What Is a Native File
A Native File is the original editable source file from which the production stitch file and cut file are derived — for example, the native Wilcom .EMB digitizing file or the original vector .AI / .CDR design file. Native files expose the full construction logic of the design and represent significant intellectual property.
6.2 Separate License Required
Native Files Are Not Included in Kit Packages
Native files are sold separately at an additional cost and require execution of a separate Native File License Agreement before delivery. No native file will be transferred without a fully signed agreement on file. Requests for native files without a signed agreement will not be fulfilled.

6.3 Native File License Terms (Summary)
The full terms of any Native File License are contained in the separately executed agreement. At minimum, all Native File Licenses:
  • Restrict use to the specific licensee named in the agreement. Native files may not be transferred, sold, or sublicensed.
  • Prohibit use of the native file or any derivative work in any educational content, course, or teaching material.
  • Require the licensee to maintain the file in a secure environment and not share access with unauthorized parties.
  • Retain all intellectual property rights in AppliqueJoe.com regardless of the license scope.
  • Specify the exact permitted commercial use — any use outside the agreement terms constitutes infringement and may result in legal action.
6.4 No Refunds on Native File Licenses
Once a native file has been delivered pursuant to a signed license agreement, all fees paid are non-refundable. The delivery of a digital file is irreversible. If the file does not match the agreed specifications, contact us within 48 hours of delivery and we will work to correct the issue.

Consulting & Private Instruction
7.1 Service Description
Consulting and private instruction services ("The Bench") are live, one-on-one sessions conducted by Joe Kramar (33+ years commercial embroidery experience) via screenshare, video call, or on-site as agreed at booking. Services include but are not limited to: production problem-solving, digitizing review, workflow consultation, machine setup guidance, and personalized digitizing instruction. The scope, duration, and deliverables of each engagement are confirmed in writing at the time of booking.
7.2 Scheduling & Cancellation
  • Sessions must be scheduled a minimum of 48 hours in advance.
  • Cancellation or reschedule requests must be received at least 48 hours before the scheduled start time.
  • Cancellations with less than 48 hours notice result in forfeiture of the full session fee. No exceptions.
  • One reschedule is permitted with adequate notice at no charge. A second reschedule is treated as a new booking at the current rate.
  • If we must cancel due to circumstances on our end, you will receive a full refund or reschedule at your preference.
7.3 Session Recording & Deliverables
Sessions are recorded in full. The recording is provided to you following the session and is licensed for your personal and internal business use only. Any files, templates, or materials provided during the session are similarly licensed for your personal business use and may not be redistributed, resold, or incorporated into any educational content without prior written consent.
7.4 Confidentiality
We treat your production challenges, business information, and creative work shared during sessions as confidential and will not disclose them to third parties without your consent. You similarly agree to treat any proprietary methods, techniques, or workflows discussed during your session as confidential to AppliqueJoe.com and not to share them publicly or incorporate them into competing educational content.
7.5 Refund Policy
Session fees are non-refundable once a session has begun. If you are dissatisfied for any reason, contact us within 48 hours of your session. Any resolution is at our sole discretion and does not constitute a standing refund policy.
7.6 No Outcome Guarantee
We provide expert consultation and instruction based on decades of professional experience. We do not guarantee any specific production result, business outcome, or skill level following a session. Results depend on your own effort, equipment, materials, software, and application of the guidance provided.

Speaking & Event Appearances
8.1 Service Description
Joe Kramar is available for trade show presentations, corporate training events, brand education sessions, industry panels, and on-site teaching engagements. Speaking engagements are subject to availability and must be confirmed in a separate written agreement ("Speaking Agreement") that specifies the event date, location, topic, duration, technical requirements, compensation, and cancellation terms. These Terms apply to all speaking engagements in addition to the specific Speaking Agreement.
8.2 Booking & Deposit
  • All speaking engagements require a non-refundable deposit of no less than 50% of the agreed speaking fee to confirm the booking. The deposit amount is specified in the Speaking Agreement.
  • The remaining balance is due no later than 14 days before the event date unless otherwise specified in the Speaking Agreement.
  • A booking is not confirmed until the deposit is received and the Speaking Agreement is fully executed by both parties.
8.3 Cancellation by Client
  • 60+ days before event: Deposit forfeited. No further obligation.
  • 31–59 days before event: 75% of total fee due.
  • 30 days or fewer before event: 100% of total fee due.
All cancellations must be received in writing. Specific cancellation terms may be modified in the Speaking Agreement. In case of conflict, the Speaking Agreement controls.
8.4 Cancellation by AppliqueJoe.com
In the event we must cancel due to illness, emergency, or circumstances beyond our control, we will provide as much advance notice as possible and offer a full refund of all amounts paid or, where feasible, an alternate date. Our liability for cancellation is limited to the refund of fees paid — we are not responsible for travel costs, accommodation, or other expenses incurred by the client.
8.5 Travel & Expenses
Travel, accommodation, and meal expenses for in-person engagements are the responsibility of the client unless otherwise specified in the Speaking Agreement. Travel arrangements should be coordinated with us at least 21 days before the event. Economy airfare and standard hotel accommodations are standard unless otherwise agreed.
8.6 Intellectual Property — Presentations
All presentation content, materials, slides, demonstrations, and proprietary methods shared during speaking engagements remain the intellectual property of AppliqueJoe.com. The client may not record, reproduce, distribute, or use presentation content in any derivative educational or commercial material without prior written consent. Recording for internal archival use only may be permitted with advance written approval.
8.7 Technical Requirements
The client is responsible for providing the technical setup specified in the Speaking Agreement (screen, projector, microphone, internet connection, embroidery machines, materials, etc.). Failure to provide agreed technical requirements does not reduce the fee owed. We are not responsible for presentation quality compromised by inadequate technical setup on the client's end.

Quarterly Group Events
9.1 Event Description
Quarterly group events are live educational sessions covering embroidery digitizing, appliqué workflows, and related topics conducted via our course platform. Events may be hosted live with interactive participation, recorded for later access, or both, as described at the time of registration.
9.2 Ticket Policy
  • Event tickets are non-refundable once purchased.
  • Tickets are transferable to another individual with written notice at least 24 hours before the event.
  • If we cancel or significantly alter the event, registered attendees receive a full credit toward a future event or a refund at our discretion.
  • Rescheduling does not entitle you to a refund.
9.3 Recording Access
Registered attendees receive access to the event recording as described at the time of purchase, for personal and internal business use only. Access links are non-transferable. You may not redistribute, resell, publicly post, or incorporate the recording into your own educational or commercial content without prior written consent.
9.4 Technical Requirements & Code of Conduct
Attendees are responsible for their own internet connection, hardware, and compatible device. No refunds will be issued due to attendee technical difficulties. All participants agree to conduct themselves professionally. We reserve the right to remove any participant from a live event without refund for disruptive, abusive, or inappropriate behavior.

Intellectual Property
10.1 Ownership
All content on AppliqueJoe.com — including but not limited to course materials, stitch files, cut files, native design files, design packages, video recordings, session recordings, instructional methods, proprietary frameworks, written content, visual assets, and brand identity — is the exclusive intellectual property of AppliqueJoe.com and its creator. All rights reserved.
10.2 Limited License to Customers
Your purchase grants you a limited, non-exclusive, non-transferable license to use purchased materials as specified in the applicable section of these Terms. No purchase transfers ownership of any intellectual property to you.
10.3 Prohibited Uses — All Products & Services
  • Using our materials, methods, files, or content to create a competing educational business, course, or instructional product.
  • Publicly representing our proprietary digitizing methods, frameworks, or techniques as your own original work or teaching.
  • Screen-capturing, extracting, or otherwise reproducing course or session content for redistribution.
  • Sharing login credentials, download links, access codes, or files with any third party not authorized under the applicable license.
Violation Consequences
Violation of intellectual property terms may result in immediate termination of all access without refund and may subject you to civil and criminal legal action under applicable copyright, trade secret, and unfair competition laws.

Payment Terms
All prices are listed in U.S. Dollars. Payment is due in full at the time of purchase or booking unless a payment plan has been agreed. We accept payment through the methods listed on our platform at the time of transaction. All transactions are processed through secure third-party payment processors. We do not store your payment card information. Prices are subject to change without notice. The price displayed at the time of your purchase is the price you will pay.

Indemnification
You agree to indemnify, defend, and hold harmless AppliqueJoe.com, its owner, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: your use of our products or services; your violation of these Terms; your infringement of any intellectual property or other rights; or any production outcomes achieved using our files or methods.

Third-Party Software Disclaimer
Instruction sessions, courses, and events may reference or demonstrate third-party software including but not limited to Wilcom, Pulse/Tajima, Embrilliance, Hatch, Adobe Illustrator, CorelDRAW, Lightburn, and others. AppliqueJoe.com has no affiliation with these companies and makes no warranty regarding the performance, availability, licensing terms, or suitability of any third-party software. You are responsible for obtaining valid licenses to any software you use. We are not responsible for any changes, errors, or discontinuations of third-party software referenced in our instruction.

Privacy
By purchasing or registering, you consent to our collection and use of your contact information (name, email, phone) for order fulfillment, session scheduling, event communication, and periodic updates from AppliqueJoe.com. We do not sell your personal information to third parties. Our course platform (Course Creator 360 / GoHighLevel) maintains its own privacy and data practices. You may opt out of marketing communications at any time by contacting us at reply@appliquejoe.com.

Governing Law
These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 18 shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction of such courts.

Dispute Resolution & Arbitration
Please Read This Section Carefully — It Affects Your Rights
Any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of any product or service from AppliqueJoe.com shall be resolved by binding arbitration administered in Maricopa County, Arizona, rather than in court. You waive any right to a jury trial.
Exceptions to arbitration:
  • Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
  • Either party may bring a claim in small claims court if it qualifies under Arizona law.
Arbitration shall be conducted on an individual basis. You may not bring class, collective, or representative claims. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our products or services following any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
